1. Acceptance of terms

By downloading, installing, or using the Play Safe app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree with these terms, please don't use the App.

We may update these terms from time to time. If we make changes, we'll update the "Last updated" date at the top of this page. Continued use of the App after changes are posted constitutes your acceptance of those changes.

2. Description of service

Play Safe is a sexual health tracking application that allows you to:

  • Log sexual activity and partner information
  • Record STI test results
  • View a personalized safety score
  • Receive testing recommendations
  • Send anonymous notifications to past partners
  • Access sexual health educational content

The App stores your personal data locally on your device. For more details on how we handle data, see our Privacy Policy.

3. Medical disclaimer

This is the most important section. Please read it carefully.

Play Safe is not a medical device and does not provide medical advice. Nothing in the App should be interpreted as a medical diagnosis, treatment recommendation, or substitute for professional medical advice.

About safety scores and risk estimates

The safety scores, risk estimates, and testing recommendations provided by Play Safe are best-effort guesses based on:

  • The information you enter into the App (your sexual activity, protection used, partner information, test results)
  • Publicly available statistics on STI prevalence and transmission rates from sources like the CDC and WHO
  • Statistical models that estimate risk based on these inputs

These are statistical estimates, not medical diagnoses. They have significant limitations:

  • They are only as accurate as the information you provide
  • They rely on general population statistics that may not apply to your individual circumstances
  • They cannot account for all risk factors
  • They assume you do not have symptoms. If you have symptoms of an STI, you should see a healthcare provider regardless of what the App says.

Always consult a healthcare professional

You should always consult with a qualified healthcare professional for medical advice, diagnosis, or treatment. This includes (but is not limited to):

  • Deciding whether or when to get tested for STIs
  • Interpreting your STI test results
  • Making decisions about treatment
  • Assessing your individual risk factors
  • Any time you have symptoms or health concerns

Do not delay seeking medical advice or disregard medical advice because of something you read or see in the App.

4. Your responsibilities

When using the App, you agree to:

  • Provide accurate information: The quality of your safety score and recommendations depends on the accuracy of the data you enter. We're not responsible for outcomes resulting from incorrect information.
  • Keep your device secure: Since all your data is stored locally on your device, you are responsible for keeping your device secure (e.g. using a passcode or biometric lock). We recommend not jailbreaking or rooting your device, as this may compromise its security.
  • Use the App responsibly: Don't use any feature of the App to harass, threaten, or harm others.
  • Be at least 18 years old: The App is intended for users aged 18 and above.

5. Anonymous notifications

Play Safe includes a feature that allows you to anonymously notify past sexual partners about a positive STI test result. By using this feature, you agree to the following:

  • Legitimate use only: You must only use this feature for its intended purpose: notifying past partners about a genuine positive STI test result. Sending false, misleading, or harassing notifications is strictly prohibited.
  • Legal consequences: Under many jurisdictions, using a communication service to menace, harass, or cause offence is a criminal offence. We take misuse seriously.
  • Data retention: When you use this feature, we may record your IP address and other metadata. If misuse is reported to law enforcement by a recipient, we may cooperate with the investigation and share this data.
  • No guarantee of delivery: We'll do our best to deliver notifications, but we can't guarantee delivery. Recipients can also opt out of receiving future notifications.

6. Partner linking

Play Safe offers an optional feature that allows two consenting users to link with each other as partners ("Partner Linking"). By using this feature, you agree to the following:

  • Mutual consent: Both parties must explicitly initiate or accept the link. Sharing your pairing link with anyone you don't intend to pair with, or pairing without the other person's clear consent, is prohibited.
  • What is shared: Linking shares your per-STI risk values, the dates and per-STI results of your tests, and the sexual encounters you log against the linked partner. Encounters with other partners are never shared. See the Privacy Policy for the full description.
  • End-to-end encryption and accuracy: All shared data is encrypted on your device before it leaves it; the relay server cannot read it. We cannot verify that what either party logs is accurate. You are responsible for what you log; you accept that the other party is responsible for what they log, and that the safety-score math reflects whatever they entered.
  • Unlinking: Either party can disconnect the link at any time from within the app. Doing so deletes the encrypted data on the relay; the history that was already synced to each device stays on that device.
  • Premium feature: Initiating or accepting a partner link is a Premium feature (see below). Unlinking is always available, including after a Premium subscription lapses.

7. Events

Play Safe offers an optional event management feature that lets organisers set a safety bar for an event, scan attendees in, and send a private notification if someone later tests positive. By using this feature (whether as an organiser or an attendee), you agree to the following:

  • Legitimate use only: you may only use the events feature to manage or attend genuine events. Creating events for the purpose of collecting contact information, sending harassment, or misrepresenting health data to inflate or suppress safety scores is strictly prohibited.
  • Accuracy of information: as an attendee, the QR code you present encodes your current safety score and test history. You are responsible for the accuracy of the data you enter into the app. As an organiser, you are responsible for making admission decisions in good faith based on the displayed information.
  • Notification consent: by joining an event (having your QR scanned by an organiser), you consent to receiving a generic, contentless nudge push/email/SMS from Play Safe's infrastructure if someone at the event later tests positive during the notification window. This message carries no health or identifiable content; it only prompts you to open the app.
  • Organiser data retention: as an organiser, you acknowledge that your device stores a local roster of admitted participants and their encrypted contact blobs. You are responsible for the security of your device. If you delete the event from within the app, all associated server-side records and relay slots are deleted.
  • No guarantee of delivery: push notifications, emails, and SMS messages may not be delivered due to carrier restrictions, device settings, or network conditions. Play Safe is not liable for undelivered notifications or health outcomes resulting from non-delivery.
  • End-to-end encryption: health detail (STI names, optional name and description) travels exclusively as end-to-end encrypted relay messages. Play Safe's servers never see this content. See our Privacy Policy for the full technical description.

8. Premium subscriptions

Play Safe offers optional premium features available through in-app purchases ("Premium"). By subscribing to Premium:

  • Purchases are processed through Apple (App Store) or Google (Google Play) depending on your device.
  • Payment is charged to your Apple ID or Google account at confirmation of purchase.
  • Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription in your device's app store settings.
  • Refunds are handled according to Apple's or Google's respective refund policies.

We reserve the right to change Premium pricing or features. Changes will not affect active subscription periods.

9. Intellectual property

The App, including all code, design, content, and branding, is owned by Play Safe and protected by copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, or distribute the App or any part of it
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use our trademarks, logos, or branding without prior written permission

Your data is yours. We don't claim any ownership over the data you enter into the App. Since your data is stored on your device, you have full control over it.

10. Limitation of liability

To the fullest extent permitted by applicable law:

  • The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
  • We do not warrant that the App will be uninterrupted, error-free, or completely secure.
  • We are not liable for any health outcomes, medical decisions, or personal consequences based on information provided by the App, including safety scores, risk estimates, and testing recommendations.
  • We are not liable for any loss of data resulting from device damage, loss, or app deletion.
  • In no event shall our total liability exceed the amount you paid for Premium features in the 12 months preceding the claim, or $50 (USD), whichever is greater.

11. Indemnification

You agree to indemnify and hold Play Safe harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your misuse of the anonymous notification feature.

12. Modifications to the App and Terms

We may update, modify, or discontinue the App (or any part of it) at any time, with or without notice. We'll do our best to notify you about significant changes.

We may also update these Terms from time to time. We'll update the "Last updated" date at the top when we do. Your continued use of the App after changes constitutes acceptance.

13. Termination

You can stop using the App at any time by deleting it from your device. This also deletes all locally stored data.

We may terminate or suspend your access to certain features (such as anonymous notifications) if we believe you are violating these Terms or using the App in a way that could harm others.

14. Governing law & disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.

If you have a dispute with us, we'd like to resolve it informally first. Please contact us at the email below, and we'll do our best to work things out. If informal resolution isn't possible, any disputes shall be submitted to the competent courts of the Netherlands.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.
